You need an Apostille when using a document issued in BiH in a country that is a contracting party to the 1961 Hague Convention. It is generally not required for Croatia, Serbia, Montenegro, Turkey or Austria. When a document needs an Apostille and when it does not
An Apostille is required by contracting parties to the Hague Convention with which BiH has no separate agreement, such as Germany, Switzerland, the Netherlands, the United States, the United Kingdom and the Scandinavian countries. It is not required for countries with which BiH has bilateral agreements waiving legalisation, such as Croatia, Serbia, Montenegro, Turkey and Austria. If a country is neither a contracting party to the Convention nor has an agreement with BiH, full legalisation by the Ministry of Foreign Affairs of BiH is required.
In BiH, an Apostille is issued by the competent municipal court (the basic court in Republika Srpska) according to the place where the document was issued, not your place of residence. An Apostille for a birth certificate issued in Mostar must be obtained from the Municipal Court in Mostar. The order is important: the Apostille is affixed to the original before translation, after which the sworn interpreter translates the entire instrument, including the text of the Apostille itself, as institutions generally require a translation of the complete document.
